Bob Sims obtained a verdict in a case involving an alleged non-disclosure of defects in a single family home in Granite Bay. As of the writing of this, while the verdict has been rendered cost issues are still being litigated.
This matter involved a single family home wherein plaintiff claimed that expansive soils were not disclosed to the plaintiffs during the sale of their home. They claimed problems with the stucco, concrete, drywall, drainage and pool. Plaintiff’s counsel requested an award of $724,224 in damages. Bob defended claiming that any indications of expansive soils were observable at the time of purchase.
Plaintiff’s lowest demand was $125,000.
Bob’s clients were uninsured and offered a total of $20,000 in a sliding scale prior to trial.
In January, an Award was issued for a total of $4,898. This is less than 1% of the claimed damages.
